| A variety protection applicant can file an application with following elements ; the name and address of the applicant(agent)and the breeder ; the identification of the botanical taxon ; the nomination of the variety ; technical and procedural description of the variety breeding ; photographs and seed samples, etc. |
Examination of Application |

| An examiner shall examine whether an applied variety meets the requirements for the variety pro-tection by investigating database and documents, and testing the applied variety with tandard and similar variety in the field for two years. |
Publication of Application |

| The Office shall publicize the application by publishing the application in the Variety Protection Gazette which is published every month. |
DUS test |
 |
| The DUS test for the applied varieties is carried out in one of the testing stations in the KSVS ; Distinctness in the comparison with existed varieties ; Uniformity in the similarity among individuals of the variety ; Stability to be sure the conformity of all batches produced. |
Publication of the Application for public Inspection |

| Where the examiner finds no reason for rejecting the application, he shall render a decision that the application is to be published, and shall publish the application in the Official Gazette for public inspection. |
Decision on Grant of Veriety Protection |
 |
| Where no grounds for rejecting a variety protection application are established, the examiner shall render a decision that variety protection is to be granted for the application, and shall publish the decision in the Gazette. |
